Terms of Service

Acceptance of Terms

These Terms of Service (“Terms”) govern your use of the FixLane mobile application and website (the “Service”), operated by FixLane. By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

What FixLane Is

FixLane is a platform that connects vehicle owners and drivers in the Greater Toronto Area who need roadside assistance (such as flat tires, dead batteries, towing, fuel delivery, or oil changes) with independent, third-party service providers. FixLane does not itself provide roadside assistance, towing, or repair services, and is not a party to the agreement between a driver and a service provider for the work performed.

Accounts

You must provide accurate information when creating a driver or provider account and keep your login credentials secure. You are responsible for activity that occurs under your account.

Service Providers

Service providers on FixLane are independent businesses or contractors, not employees or agents of FixLane. Providers must complete FixLane’s verification process, which may include identity documents, business or towing certification, and photo verification, before being approved to accept requests. FixLane may periodically re-verify provider information and may suspend or remove a provider account that no longer meets our standards.

Requests, Quotes, and Fees

When a driver submits a request, nearby providers may respond with a quote. Any price agreed between a driver and a provider is between those two parties. FixLane may charge a platform fee to providers for successfully completed jobs booked through the Service, as disclosed at the time of booking. Payment for the underlying roadside service is arranged between the driver and the provider; payment card processing on the platform is handled by our payment processor, Stripe.

Driver Responsibilities

Drivers agree to provide accurate vehicle and location information, to be reasonably available at the stated location for the scheduled assistance, and to treat providers respectfully.

Cancellations

Either a driver or a provider may cancel a request before work begins. Repeated or last-minute cancellations may affect your ability to use the Service.

Disclaimers

The Service is provided “as is.” FixLane does not guarantee the availability, quality, timeliness, or outcome of any roadside assistance service performed by a third-party provider. FixLane is not responsible for damage to a vehicle, injury, or loss arising from services performed by a provider; any such claim should be directed to the provider and, where applicable, their insurance.

Limitation of Liability

To the maximum extent permitted by law, FixLane’s total liability arising out of or relating to the Service is limited to the platform fees FixLane actually received in connection with the request giving rise to the claim.

Termination

FixLane may suspend or terminate an account that violates these Terms, provides false verification information, or otherwise misuses the Service.

Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.

Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
